Terms & Conditions
Ridgeland Plumbing (RP) will perform for the Customer the Work identified in the associated Estimate/Invoice for the price indicated. All work performed by RP shall be completed in a prompt and professional manner according to standard practices and under applicable Municipal and State Codes.
Estimates: Estimates expire after 30 days, and the price may be increased by the amount of any reasonable increase in the cost of Materials and Products beyond the control of RP or changes beyond the agreed-upon work specified within the Estimate. The Customer’s Signature upon the Estimate indicates they have read and understand the Full Terms and Conditions and agree to the work and price outlined within the Estimate. After the Customer's approval of the Estimate, work will be scheduled upon receipt of deposit as follows, unless otherwise noted. 75% of final payment is required before work starts, to be applied towards materials, permitting, and to hold scheduled appointment. Final payment will be due upon completion of work.
Agreement: There are no promised, terms, conditions, or obligations other than those contained within the Estimate/Invoice, or RP’s Terms and Conditions. The signed Estimate/Invoice of agreed-upon work supersedes all prior communications, representations, or agreements, either verbal or written.
Payment: The customer will provide Payment Upon Receipt, or within the time frame agreed upon within the Invoice. Accepted payments include Check, Cash, and Credit Card. Credit Card payments are subject to a 3% fee. If a Check is returned for non-sufficient funds, the Customer will be charged the full amount plus any applicable fees. The use of a Credit Card or Check for payment is the Customer’s acknowledgement and acceptance of this policy and Terms and Conditions. Payments not received in full at time of service are subject to a late fee and/or interest. Unpaid invoices after 30 days are subject to collections. We reserve the right to withhold any future work at any point if payment is not made in full and in a timely manner.
Permit Fees: Permit fees are not included, unless otherwise noted in the Estimate/Invoice, and will be at an additional cost which the Customer agrees to pay within the agreed upon payment schedule.
Customer Preliminary Requirements: Prior to RP commencing Work, the customer shall, at their sole cost and expense, complete engineering, survey, or other plans for the project and obtain any federal, state, and municipal approvals or permits required for work to be performed, unless otherwise agreed upon within the Estimate/Invoice. Prior to RP arriving for Work, the project site must be clear of any debris, equipment, personal items and/or construction materials that would interfere with the performance of the Work. RP is not responsible for damage or cleanup that may result from Customer’s non-compliance to this agreement. Customer’s failure to meet these conditions prior to start of Work shall constitute breach of this agreement and may result in damages as defined in the Damages section.
Changes To Work: The Customer may order changes to the Work, including, but not limited to, additions, deletions, or modifications, with the understanding that the price may be altered to reflect these changes.
Changes to Work: may be made as the work progresses, and the Customer agrees that any changes to the Work done by RP which differ from the written Estimate/Invoice, shall be conclusive proof of the Customer’s authorization of the change. The Customer agrees to pay all costs associated with any agreed upon changes which will be reflected in the Final Invoice. RP is not liable for existing conditions and the Customer will pay all costs that may occur, if necessary or required by the local Code Official to upgrade the current status for a safe and proper working system. The Estimate/Invoice is based on the Visible Conditions and the Customer agrees that the price may vary due to non-visible conditions.
Work Outside Job Scope: Work which RP is not licensed, insured or capable of completing may be necessary or required and is not included unless otherwise noted. RP does not warranty or guarantee Fixtures and/or Materials. Customer agrees to pay any additional fees that may occur for repair, replacement, or reinstallation of Fixtures and/or Materials. The Customer is responsible for and/or agrees to pay for any cost associated with drilling for any plumbing pipes, roof cuts, installation of roof vent flanges, patch and repairs to any wall, ceiling, floor, or caulking, concrete cutting, removing and patching, trenching, back-filling and tamping of earth, electrical or other wiring, or disposal cost for removal of old material or fixtures.
Environmental Conditions: The Work contemplated by RP presumes that no permits are required from any environmental impacts, and should such permits be required the Customer is responsible for all things relating to such permits and requirements.
Completion: RP will complete the Work agreed upon in the Estimate/Invoice and any change orders as quickly as practicable. The Customer agrees, however, that RP shall not be responsible for any damages to the Customer, either direct or incidental, arising from any delays in completing the Work before any date previously discussed, unless explicitly agreed upon in writing between RP and the Customer. Work dates are subject to change due to unforeseen circumstanced and will be rescheduled in a timely manner.
Termination: RP may terminate the contract either for causes arising from the Customer’s inability or refusal to pay Invoices in a timely manner, or alternatively, from the Customer’s failure to agree to a change order arising from differing site conditions identified after commencing the Work that would make the Work impractical or impossible to perform. The Customer may terminate the contract prior to completion of the Work but shall pay RP for Work completed and not yet paid, and for materials purchased specifically for this Invoice, and for all resulting direct and incidental costs and damages identified in Damages.
Warranty: All work described in the Estimate/Invoice has a Limited Warranty on Workmanship unless otherwise noted. All suppled Fixtures or Materials are subject to the Manufacturer Warranty. The Customer is responsible for submitting all Manufacture Warranty Registrations. Limited Warranty is Void if an Invoice remains unpaid. RP is not responsible for the Fixtures or Materials; these items are subject to Manufacturer and Supplier Guarantees. RP is not responsible for Existing Plumbing Conditions or Water Quality.
Damages: RP is not liable for any unknown, unforeseen, or preexisting problems and/or conditions with existing plumbing systems. RP is released from any liability arising from Work done including, but not limited to damage to pipes, drains, sewer lines caused by drain cleaning or any other damage arising in the course of cleaning any drain or sewer lines, nor does RP assume any responsibility for breakage of any toilet, P-trap or fixture while being pulled, nor any damages to property from new or defective replacement parts manufactured by others.
The Customer agrees that any breach of the Contract resulting in damages to RP, including all direct and incidental damages arising from the breach. Customer agrees that RP’s damages shall include, but not be limited to RP’s time resources, equipment, and overhead used in mobilization, purchasing materials, and preparing plans, or loss of reasonably anticipated profits on the project. The Customer’s breach or termination of this agreements, losses arising from delays during the project awaiting Customer’s receipt of any plans, approval, or permits for RP to compete the work not arising from negligence and RP’s reasonable attorney fees and costs associated with any legal action as a result of Customer breach, including Mechanic’s Lien.
Indemnification: Customer shall defend, indemnify, and hold RP harmless from any and all claims, penalties, or assessments arising from the breach of any covenant, representation or warranty herein, or from any act, omission, or misrepresentation of the Customer and/or employees, agents, or representatives, including architects, engineers, surveyors, or others engaged to perform preliminary steps necessary for Work to be performed. This indemnification shall be as broad as permissible by the law.
Legal Proceedings: Any legal action shall be pursued in the courts of Colorado, and notwithstanding any conflict of law principles, shall be governed by Colorado law. Payments not made in full will be subject to property lien. Acceptance of the Estimate/Invoice is considered legal notice of property lien.
Photos/Testimonials: Customer agrees to allow RP use of any photos, or testimonials, written or verbal, as pertains to the Work performed for purpose of advertising and example, without penalty or fees from the Customer.
